New Jersey offers both fault grounds and no-fault grounds for divorce. Spouses alleging fault can do so on grounds including adultery, desertion and extreme cruelty. In a no-fault divorce, spouses can file by citing irreconcilable differences that have lasted for six months or more. You don’t have to be living in different houses to file on this basis. You can also file on the grounds of having lived apart for at least 18 months but that basis is not very common anymore since the grounds of irreconcilable differences was added to the law. In New Jersey, both parties do not have to agree to divorce. The party who files for divorce will receive a divorce even if the other party does not want one.
An uncontested divorce does not mean that both of you agree to the divorce or because the grounds are based on irreconcilable differences; it means that you have resolved all the issues involving custody, child support, alimony and equitable distribution and the only thing left is for the court to grant a divorce. The term really means that the case has been settled between you without the need for a trial. The divorce will ultimately become “uncontested” even if you file for grounds other than irreconcilable differences as long as the issues are settled without the need for a trial.
A divorce trial is only necessary if the divorce is “contested”. In New Jersey, about 98% of the cases –even those that start of as contested – end up settling and becoming “uncontested”. Settlement is the goal of everyone including the courts. Four way conferences as well as mediation, often resolve issues.
